These terms govern the use of the WeWander marketplace platform by travelers who book activities through our platform. Please review this document carefully.
These Traveler Terms and Conditions ("Terms") constitute a binding legal agreement between you ("Traveler," "you," or "your") and MB "Wewander" ("WeWander," "we," "us," or "our") governing your use of the WeWander platform and services.
BY CREATING AN ACCOUNT, BOOKING AN ACTIVITY, OR USING OUR PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS. If you do not agree to these Terms, you may not use the Platform.
Key point: WeWander is a marketplace intermediary — not a tour operator, travel agent, or organizer. The contract for each activity is formed directly between you and the operator.
WeWander operates as a marketplace platform and booking intermediary. WeWander is NOT a tour operator, travel agent, or organizer under EU or Lithuanian law.

When you book an Activity through the Platform:
WeWander does NOT act as an "organizer" or "retailer" under Directive (EU) 2015/2302 (Package Travel Directive). Each Activity is a standalone booking with an individual Operator. WeWander does not combine travel services into packages or offer linked travel arrangements.

Key point: WeWander offers three booking methods: Instant Booking (confirmed immediately), Request to Book (operator confirms within 24 hours), and Private Tour Date Requests (operator responds within 48 hours). All payments are processed in EUR via credit card, debit card, or PayPal.
Activity listings are created and maintained by Operators. WeWander is not responsible for:

Upon successful booking, you will receive:
Operators will provide final confirmation and detailed instructions 24–48 hours before the Activity date.
Key point: Cancellation policies are set by each operator and displayed before checkout. Standard options include Flexible (full refund 24+ hours before), Moderate (full refund 7+ days, 50% refund 1–7 days before), Strict (full refund 14+ days, 50% refund 7–14 days before), and Non-Refundable. Refunds are processed within 5–10 business days to your original payment method. If an operator cancels, you receive a full refund.
Each Activity has a cancellation policy set by the Operator and displayed before booking. Standard policies include:

Operators may also set custom cancellation policies with different refund tiers and deadlines. The specific cancellation policy applicable to your booking is always displayed before you complete your purchase.
To cancel a booking:
Refunds will be processed according to the applicable cancellation policy. Refund amounts are calculated based on the time between cancellation and Activity start time.
Approved refunds are processed within 5–10 business days to the original payment method. WeWander is not responsible for delays caused by payment processors or financial institutions.
Under EU Consumer Rights Directive 2011/83/EU Article 16(l), the standard 14-day cooling-off period does NOT apply to bookings for accommodation, transport, or leisure activities on a specific date. Your cancellation rights are governed by the Operator's cancellation policy.
If an Operator cancels your Activity for any reason:
Minimum Participants:
If an Activity requires a minimum number of participants and that minimum is not met, the Operator may cancel the Activity. In such cases, you will receive a full refund of all amounts paid.
Additional Costs:
WeWander is not legally responsible for expenses incurred in connection with a cancelled Activity (flights, accommodations, alternative arrangements) or other consequential damages.

If an Operator cancels your Activity, please contact our customer support team. While we cannot guarantee reimbursement of additional costs, we will:
We recommend purchasing travel insurance to protect against trip cancellations and related costs.
Operator-Initiated Changes:
If the Operator makes significant changes to an Activity (date, time, itinerary), you will be notified and offered the option to:
Traveler-Requested Rescheduling:
Contact the Operator directly to request rescheduling. Rescheduling is subject to Operator availability and may incur fees based on the Operator's policies.

Key point: Operators are solely responsible for activity delivery, safety, quality, and compliance with local regulations. WeWander is liable only for platform errors (e.g., incorrect pricing, payment failures) and data breaches. WeWander's maximum liability is limited to the amount paid for the specific booking.

To the maximum extent permitted by law, WeWander's total aggregate liability for any claim arising from these Terms or use of the Platform shall not exceed the amount you paid for the specific booking giving rise to the claim.
WeWander is not liable for indirect, incidental, consequential, special, or punitive damages arising from these Terms or use of the Platform, including but not limited to:

Nothing in these Terms excludes or limits WeWander's liability for:
WeWander strongly recommends that you obtain comprehensive travel insurance covering trip cancellations, medical emergencies, personal injury, and loss of personal belongings.

WeWander reserves the right to remove reviews that:
You retain ownership of reviews and photos you submit. By submitting a review, you grant WeWander a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, distribute, and modify your review for Platform operations, marketing, and promotional purposes (including social media).
You may request deletion of your review at any time by contacting info@wewander.tours, and WeWander will remove it within 30 days, except where retention is required by law.

All content on the Platform, including but not limited to text, graphics, logos, software, and design, is owned by WeWander or its licensors and protected by copyright, trademark, and other intellectual property laws.
WeWander grants you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms.

If you violate these Terms, WeWander may:
Key point: Contact info@wewander.tours with your booking number to resolve disputes. WeWander responds within 2–3 business days. EU consumers may use the EU Online Dispute Resolution platform. These terms are governed by Lithuanian law; EU consumers retain their local consumer protection rights.

This platform facilitates out-of-court resolution of disputes between consumers and businesses.
These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict of law principles. However, as a consumer, you retain the benefit of mandatory consumer protection provisions under the law of your country of residence.
For EU Consumers:
You may bring legal proceedings in either:
WeWander may only bring proceedings against you in the courts of your country of residence.
For Non-EU Travelers:
Any disputes shall be subject to the exclusive jurisdiction of the courts of Vilnius, Lithuania.
Nothing in these Terms waives your right to participate in class action proceedings or collective redress mechanisms as permitted by the laws of your jurisdiction.
Claims must be brought within the limitation period provided by applicable law. In Lithuania, the general limitation period is three years from the date the claim arose.
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and WeWander regarding use of the Platform.
WeWander reserves the right to modify these Terms at any time. Material changes will be communicated via email 30 days before the effective date. Continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
WeWander's failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
You may not assign or transfer your rights under these Terms without WeWander's prior written consent. WeWander may assign these Terms to any affiliated entity or successor without restriction.
WeWander is not liable for delays or failures in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, or internet service failures.
These Terms are provided in English. Translations may be provided for convenience, but the English version shall prevail in case of any conflict or discrepancy.
These Terms do not confer any rights upon third parties. Only you and WeWander have rights under these Terms.
